Terms of Service

The rules for using Qwaiton's website and platform.

Last updated: 25 July 2026

These Terms of Service ("Terms") govern your access to and use of the Qwaiton website and queue management platform (the "Service") provided by Qwaiton ("Qwaiton", "we", "us" or "our"). By creating an account, starting a free trial, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Qwaiton provides software for queue management, virtual queuing, appointment booking, QR check-in, visitor management, customer feedback and related analytics. We may add, change or remove features over time.

2. Eligibility & accounts

You must be at least 18 and able to form a binding contract. You agree to provide accurate information, keep your login credentials secure, and are responsible for all activity under your account. Notify us promptly of any unauthorised use.

3. Free trial

We offer a 14-day free trial with no credit card required. At the end of the trial you may choose a paid plan to continue; otherwise your account may be paused or limited. We will never charge a payment card you have not provided, and we may modify or discontinue trials at any time.

4. Plans, billing & renewals

  • Paid plans are billed in advance on a monthly or annual basis. Indicative pricing is Starter $50/mo, Enterprise $100/mo and Custom $300/mo, with annual billing discounted by up to 20%. Current pricing is shown on our Pricing page.
  • Subscriptions renew automatically for the same term unless cancelled before the renewal date. You can cancel at any time; cancellation takes effect at the end of the current billing period.
  • Fees are exclusive of taxes, which you are responsible for. Except where required by law, payments are non-refundable. We may change prices with reasonable prior notice.

5. Acceptable use

You agree not to misuse the Service, including by: breaking the law or infringing others' rights; uploading malware; attempting to gain unauthorised access; reverse engineering or copying the Service; reselling it without authorisation; or interfering with its operation or security.

6. Your data

You retain ownership of the data you submit to the Service ("Customer Data"). You grant us the limited rights needed to operate and provide the Service. You are responsible for the accuracy of Customer Data and for obtaining any consents required from your own customers (for example, before sending them notifications). We handle personal data as described in our Privacy Policy.

7. Intellectual property

The Service, including its software, design and content, is owned by Qwaiton and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. All rights not expressly granted are reserved.

8. Third-party integrations

The Service may integrate with third-party tools (such as Zapier, Zoho, GoHighLevel or Tomedo). Your use of those services is governed by their own terms, and we are not responsible for them.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Qwaiton will not be liable for indirect, incidental, special or consequential damages, or loss of profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold Qwaiton harmless from claims arising out of your use of the Service, your Customer Data, or your breach of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination, your right to use the Service ends; you may request an export of your Customer Data within a reasonable period, after which we may delete it.

13. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws rules. The courts of Ontario will have jurisdiction over any dispute, unless applicable law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
